    Tariffs: the Government summons Edenor, Edesur and other electric utilities to define rate increases

      The Government summons Edenor, Edesur and other electric companies to a hearing to move forward with an increase in the tariffs of electricity and gas services for 2022. It is within the framework of the calls already made for gas. The meeting will be held on February 17, at 8:00 a.m., and will also seek to move forward with the removal of subsidies, one of the requests of the International Monetary Fund as part of the debt restructuring negotiations.

      With Resolution 5/2022 published this Wednesday in the Official Gazette, the Government seeks to move forward with the tariff segmentation plan, reduce subsidies -that is why months ago it started with the re-registration- and adjust the tariff up to 20%, as stated by the National Energy Secretary, Darío Martínez, almost a month ago.

      The previous hearing was held at the end of March 2021, and the tariff increase that was defined then was 9%, much lower than what the distributors had requested.

      The call comes two weeks after the severe blackouts that affected more than 150,000 users and for which the distributors were sanctioned.

      What the text of the resolution says

      THE CONTROLLER OF THE NATIONAL ELECTRICITY REGULATOR RESOLVES:

      ARTICLE 1.- To call a Public Hearing in order to inform and hear opinions regarding: (i) the treatment of the determination of the seasonal reference prices of Power, Stabilized Energy in the WHOLESALE ELECTRICITY MARKET (MEM), as well as the Stabilized Price of Transportation (PET) and for the WHOLESALE ELECTRICITY MARKET OF THE TIERRA DEL FUEGO SYSTEM (MEMSTDF); (ii) the proposals of the electric power transmission and distribution public service concessionaires, aimed at obtaining a transitory adjustment of tariffs, within the ITR renegotiation process and prior to defining the tariffs to be applied by the concessionaires.

      ARTICLE 2.- The Public Hearing shall be held on February 17, 2022 at EIGHT HOURS (8:00 a.m.), its visualization and participation shall be carried out through a digital platform and its development shall be simultaneously transmitted through a streaming platform, which shall be informed through the website: https://www.argentina.gob.ar/enre/tarifas/audiencia-publica-2022.

      ARTICLE 3.- The procedure shall be governed by the Public Hearings Regulations approved by Decree Nº 1172 dated December 3, 2003 and adopted by Resolution of the ENTE NACIONAL REGULADOR DE LA ELECTRICIDAD (ENRE) Nº 30 dated January 15, 2004 and according to the instructions contained in the website indicated in Article 2.

      ARTICLE 4.- The Public Hearing shall be presided over, for the purpose of dealing with the seasonal reference prices of Power, Stabilized Energy in the MEM as well as the PET and the MEMSTDF, referred to in item (i) of Article 1 by the Secretary of Energy, Norman Darío MARTÍNEZ and by the Undersecretary of Electric Energy Federico José BASUALDO RICHARDS, who shall act jointly or alternately, being able to designate competent officials in their place.

      With respect to item (ii) of Section 1, the Public Hearing shall be presided over by the Comptroller of the ENRE, María Soledad MANIN and, jointly and/or alternately and/or successively by Marcelo BIACH and Diego BIBE, who may designate competent officers in their replacement, who shall be assisted by the Head of the Legal Department Sergio Enrique Víctor BERGOGLIO and/or his alternate Liliana Beatriz GORZELANY and/or whoever they may designate in their replacement.

      ARTICLE 6.- To appoint as Instructors the heads of the Regulatory Analysis and Special Studies Area (AARyEE) and of the Secretary of the Board of Directors (SD).

      ARTICLE 7.- The implementation, coordination and organization of the Public Hearing shall be in charge of the Intervention, which shall require the participation of the remaining organizational units of the ENRE.

      ARTICLE 8.- Any individual or legal entity, public or private, that invokes a subjective right, simple interest or right of collective incidence may participate in the Public Hearing, according to the requirements set forth in the Public Hearing procedure approved by this act, being Decree 1172/2003 supplementary applicable. Interested legal entities, organizations or entities may participate through their representatives, proving their legal capacity by means of the corresponding legal instrument, duly certified, admitting the intervention of only one speaker on their behalf. To this end, they must register via the Web in the corresponding Participants' Register and must comply with all the requirements set forth therein. Once the requirements have been completed and validated by the organization, the proof of registration shall be sent to the declared e-mail address.

      ARTICLE 9.- To enable, as from ZERO HOURS (00:00 a.m.) on January 31, 2022 and until TWENTY-THREE HOURS AND FIFTY-NINE MINUTES (23:59 p.m.) on February 14, 2022, the Participants' Registry which may be accessed through the web page: https://www.argentina.gob.ar/enre/tarifas/audiencia-publica-2022.- ARTICLE 10.- At the time of Registration, whoever requests to participate as exhibitor in the Public Hearing shall expressly state it in the Registration Form, making a summary of the content of the presentation in its pertinent part; being able to attach, in PDF file, a report of the presentation to be made, as well as any other documentation and/or proposal related to the object of the Public Hearing.

      ARTICLE 11.- At the Public Hearing, the natural persons who have registered as participants shall be entitled to ONE (1) oral intervention of FIVE (5) minutes and the representatives of the interested legal entities, agencies or organizations who have registered as participants shall be entitled to ONE (1) oral intervention of TEN (10) minutes.

      SECTION 12.- The closing report containing a summary description of the interventions and incidents of the Public Hearing, without any assessment on its contents, shall be published in the Official Gazette and in the ENRE's website (www.argentina.gob.ar/enre) within TEN (10) administrative working days as from the end of the Public Hearing.

      SECTION 13.- To publish the summons for TWO (2) consecutive days in the Official Gazette; in at least TWO (2) newspapers with national circulation and in the ENRE's website.

      To state in the publication: 1.- the purpose of the Hearing as defined in Article 1 of this Resolution; 2.- that the procedure shall be governed by the Regulations for Public Hearings approved by Decree Nº 1172 dated December 3, 2003 and adopted by Resolution of the ENRE Nº 30 dated January 15, 2004.

      3.- the appointment of the Chairmen and the Instructors provided for in Articles 4, 5 and 6 above; 4.- date and time of the Hearing. The viewing and participation will be carried out through a digital platform and will be developed simultaneously by live transmission through a streaming platform, which will be informed through the website: https://www.argentina.gob.ar/enre/tarifas/audienciatransbadistrocuyo 5.- that the proceedings may be viewed virtually through the website: https://www.argentina.gob.ar/enre/tarifas/audiencia-publica-2022 as from ZERO HOURS (00:00 a.m.) on January 31, 2022 and until TWENTY-THREE HOURS AND FIFTY-NINE MINUTES (23:59 p.m.) on February 14, 2022.

      6.- that any individual or legal entity, public or private, that invokes a subjective right, simple interest or right of collective incidence may participate, according to the requirements set forth in the Public Hearing procedure approved by Resolution ENRE No. 30 dated January 15, 2004. Interested legal entities, agencies or organizations may participate through their representatives, evidencing their legal capacity by means of the corresponding legal instrument, duly certified, and only one speaker on their behalf will be allowed.

      7.- that those who wish to participate must register in advance, from ZERO HOURS (00:00 hs.) on January 31, 2022 until TWENTY THREE HOURS AND FIFTY NINE MINUTES (23:59 hs.) on February 14, 2022, in the Participants' Registry. At the time of Registration, whoever requests to participate as exhibitor in the Public Hearing shall expressly state it in the Registration Form, making in its pertinent part a summary that reflects the content of the presentation; being able to attach a report, in PDF file, of the presentation to be made, as well as any other documentation and/or proposal related to the object of the Public Hearing.

      8.- that the closing report will be published in the Official Gazette and in the ENRE's web page (www.argentina.gob.ar/enre), within TEN (10) administrative working days as from the end of the Public Hearing.

      9.- the means by which this Call shall be disseminated.

      SECTION 15.- To inform EMPRESA DISTRIBUIDORA Y COMERCIALIZADORA NORTE SOCIEDAD ANÓNIMA (EDENOR S.A.) and EMPRESA DISTRIBUIDORA SUR SOCIEDAD ANÓNIMA (EDESUR S.A.), that they must submit the information contained in the Public Hearing.), which shall submit the information contained in IF-2022-07563864-APN-AAEFYRT#ENRE, which is part of this act, and to the transmission companies: COMPAÑÍA DE TRANSPORTE DE ENERGÍA ELÉCTRICA EN ALTA TENSIÓN TRANSENER SOCIEDAD ANÓNIMA (TRANSENER S.A.), EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBUCIÓN TRONCAL DE LA PROVINCIA DE BUENOS AIRES SOCIEDAD ANÓNIMA (TRANSBA S.A.), EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBUCIÓN TRONCAL DE LA PATAGONIA SOCIEDAD ANÓNIMA (TRANSPA S.A.), EMPRESA DE TRANSPORTE DE ENERGÍA TRONCAL DE LA PATAGONIA SOCIEDAD ANÓNIMA (TRANSPA S.A.), EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBUCIÓN TRONCAL DE LA PATAGONIA S.A.), the EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBUCIÓN TRONCAL DEL COMAHUE SOCIEDAD ANÓNIMA (TRANSCO S.A.), the EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBUCIÓN TRONCAL DEL NORESTE ARGENTINO SOCIEDAD ANÓNIMA (TRANSNEA S.A.), the EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBRIBUCIÓN TRONCAL DEL NOROESTE ARGENTINO SOCIEDAD ANÓNIMA (TRANSNOA S.A.), the EMPRESA DE TRANSPORTE DE ENERGÍA ELÉCTRICA POR DISTRIBUCIÓN TRONCAL DE CUYO SOCIEDAD ANÓNIMA (DISTROCUYO S.A.) and the ENTE PROVINCIAL DE ENERGÍA DEL NEUQUÉN (EPEN) which shall submit the information detailed in IF-2022-07562132-APN-AAEFYRT#ENRE, which is part of this document, within FIVE (5) days from the date of notification of this document.

      SECTION 16.- EDENOR S.A., EDESUR S.A., TRANSENER S.A., TRANSBA S.A., TRANSPA S.A., TRANSCO S.A., TRANSNEA S.A., TRANSNOA S.A., DISTROCUYO S.A. and EPEN shall be notified.

      SECTION 17.- The SECRETARY OF ENERGY, COMPAÑÍA ADMINISTRADORA DEL MERCADO MAYORISTA ELÉCTRICO SOCIEDAD ANÓNIMA (CAMMESA), the Users' Associations registered in the National Registry of Consumers' Associations of the Undersecretariat for Consumer Defense (R.N.A.C.), the Residential Users' Commission (R.N.A.C.) and the Residential Users' Commission (R.N.A.C.) shall be notified.), the Residential Users' Commission (CUR), the Association of Electric Power Distributors of the Argentine Republic (ADEERA), the Association of Electric Power Transporters of the Argentine Republic (ATEERA), the Association of Large Electric Power Users of the Argentine Republic (AGUERA), the Association of Electric Power Generators of the Argentine Republic (AGEERA) and the Association of Electric Regulatory Entities (ADERE), the National Ombudsman's Office and the National Consumer Defense Office.

      ARTICLE 18.- The sectorial authorities of the Provinces, as well as the Ombudsmen's Offices of each of the provincial jurisdictions, shall be invited to participate, to which end the necessary communications shall be made.

      SECTION 19.- Be it communicated, registered, published for TWO (2) consecutive days, sent to the National Directorate of the Official Registry and filed.
