    Maine PUC Issues Order Approving Requests for Standard Offer Proposals Involving 3 Companies

      AUGUSTA, Maine, Sept. 15 -- The Maine Public Utilities Commission issued the following order approving requests for standard offer proposals (No. 2023-00092) on Sept. 13, 2023:

      MAINE PUBLIC UTILITIES COMMISSION, Standard Offer Bidding Procedure for Central Maine Power (all classes), Versant Power-Bangor Hydro District (all classes), and Versant Power-Maine Public District (all classes)

      ORDER APPROVING REQUESTS FOR STANDARD OFFER PROPOSALS

      BARTLETT, Chair; SCULLY and GILBERT, Commissioners

      Pursuant to the Delegation Order issued in Standard Offer Bidding Procedure, Docket No. 2004-00314 (May 18, 2004), I approve the attached Requests for Proposals to Provide Standard Offer Service (RFPs) and associated documents and procedures for the Central Maine Power Company (CMP) (all classes), Versant Power-Bangor Hydro Electric Division (BHD) (all classes), and Versant Power-Maine Public District (MPD) (all classes). As part of these three RFPs, I also approve standard form standard offer service agreements applicable to all solicitations.

      On July 28, 2023, CMP proposed revisions with respect to Exhibit A, namely the current adder levels for the uncollectible accounts associated with standard offer service in CMP's service territory for the residential/small non-residential customer class, and the medium non-residential class. I approve Exhibit A for CMP, including CMP's proposed revisions.

      On July 28, 2023, as revised and updated on September 8 & 11, 2023, Versant Power filed proposed revisions to Exhibit A, namely the current adder levels for the uncollectable accounts associated with standard offer service in the BHD service territory for the residential/small non-residential customer class, and the medium nonresidential class, and in the MPD service territory for the residential/small nonresidential customer class, and the medium non-residential class. Versant Power's revised Exhibit A for each service territory also reflects several non-substantive updates and clarifications. I approve Exhibit A for BHD and MPD, including Versant Power's proposed revisions.

      NOTICE OF RIGHTS TO REVIEW OR APPEAL

      5 M.R.S. Sec. 9061 requires the Public Utilities Commission to give each party at the conclusion of an adjudicatory proceeding written notice of the party's rights to seek review of or to appeal the Commission's decision. The methods of review or appeal of Commission decisions at the conclusion of an adjudicatory proceeding are as follows:

      1. Reconsideration of the Commission's Order may be requested under Section 11(D) of the Commission's Rules of Practice and Procedure (65-407 C.M.R. ch. 110) within 20 days of the date of the Order by filing a petition with the Commission stating the grounds upon which reconsideration is sought. Any petition not granted within 20 days from the date of filing is denied.

      2. Appeal of a final decision of the Commission may be taken to the Law Court by filing, within 21 days of the date of the Order, a Notice of Appeal with the Administrative Director of the Commission, pursuant to 35-A M.R.S. Sec. 1320(1)-(4) and the Maine Rules of Appellate Procedure.

      3. Additional court review of constitutional issues or issues involving the justness or reasonableness of rates may be had by the filing of an appeal with the Law Court, pursuant to 35-A M.R.S. Sec. 1320(5).

      Pursuant to 5 M.R.S. Sec. 8058 and 35-A M.R.S. Sec. 1320(6), review of Commission Rules is subject to the jurisdiction of the Superior Court.
